Terms and conditions

These terms apply to your use of Emberly at emberlycert.app and our mobile apps. By creating an account you agree to them on behalf of yourself and your company.

Your account

You must give accurate details and keep your login secure. Account owners are responsible for the team members they invite and the permissions they give them.

Plans and payment

Paid plans are billed monthly in advance through Stripe. You can cancel at any time from Plan & billing; you keep access until the end of the period already paid. Fees are non-refundable except where the law requires. We may change prices with reasonable notice.

Certificates and compliance

Emberly provides templates based on model wording from BS 5839-1 and related standards. Responsibility for the accuracy of certificates and for compliance rests with the competent person who completes and signs them.

Your data

You own the data you put into Emberly. You give us permission to store and process it only to provide the service, as described in our privacy policy. You must have the right to upload any customer data you add.

Third-party services

Optional integrations such as Xero are governed by those providers' own terms as well as these. You can disconnect them at any time.

Acceptable use

Don't misuse the service, attempt to access other companies' data, send spam, or upload unlawful content. We may suspend accounts that do.

Availability and liability

We work to keep Emberly available and reliable but can't guarantee it will be uninterrupted or error-free. To the extent the law allows, our total liability is limited to the fees you paid in the 12 months before the claim, and we are not liable for indirect or consequential losses. Nothing limits liability that cannot be limited by law.

Ending the agreement

You can close your account at any time. We may end or suspend access for serious breach of these terms. You can ask us to export your data before closure.

General

We may update these terms and will tell you about significant changes. These terms are governed by the laws of England and Wales.
